The headline asks, “Will legal marijuana put an end to Massachusetts’ black market?”

Many residents of Massachusetts avoid the sales tax by shopping in New Hampshire or on line from out of state sellers that do not collect it. Few declare and pay the tax due for such purchases with their state income taxes.

The illicit market created by years of civil disobedience of total prohibition will continue to thrive because it can under-price licensed establishments by at least the amount of the tax.

No sane person can expect adult cannabis consumers with connections to the illicit market, gifts from those who legally grow their own, or do so themselves, not to avoid the 20 percent tax.

Expectations that they will is the new “reefer madness.”
